TO THE FULLEST EXTENT PERMITTED BY LAW, CRASH FILE GARAGE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Crash File Garage does not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that crashfilegarage.com or the servers that make the Service available are free of viruses or other harmful components. IN NO EVENT SHALL THE TOTAL LIABILITY OF CRASH FILE GARAGE TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO CRASH FILE GARAGE, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

Upon termination, your right to use the Service will immediately cease, and we may delete your account and all associated User Content without liability to you.
The following provisions shall survive termination of these Terms: Sections 5 (Intellectual Property Rights), 6 (User Content), 7 (Disclaimers), 8 (Limitation of Liability), 9 (Indemnification), 11 (Governing Law), and any other provisions that by their nature should survive termination.
11. Governing Law and Dispute Resolution
These Terms and any dispute or claim arising out of or related to these Terms or the Service shall be governed by and construed in accordance with the laws of the United States and the state in which Crash File Garage is headquartered, without regard to its conflict of law provisions.
Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the federal or state courts located in the jurisdiction where Crash File Garage maintains its principal place of business, and you consent to the personal jurisdiction of such courts. You waive any objection to venue in such courts and any claim that such courts are an inconvenient forum.

If for any reason a claim proceeds in court rather than in arbitration, both you and crashfilegarage.com waive any right to a jury trial.
